Carbon Pricing in the Northeast: Looking through a Legal Lens

Janet E. Milne

National Tax Journal, 2017, vol. 70, issue 4, 855-878

Abstract: This article explores carbon pricing in seven states in the Northeast. It surveys existing measures, focusing on the regional cap-and-trade program (the Regional Greenhouse Gas Initiative, or RGGI) and fuel taxes. It then looks at RGGI and bills that have been introduced in six states in the Northeast that call for carbon taxes, fees, or charges. It pays particular attention to how legal considerations may influence decisions about RGGI and the design of carbon taxes, fees, and charges.
