Abstract:
Court of Justice of the European Union, C-783/19, Comité Interprofessionnel du Vin de Champagne v GB, EU:C:2021:713, 9 September 2021In its judgment of 9 September 2021 in case C-783/19, the Court of Justice of the European Union essentially clarified whether the use for services of a sign that constitutes an evocation of a protected designation of origin (‘PDO’) and protected geographical indication (‘PGI’) and exploits this PDO’s/PGI’s reputation is prohibited under EU law, and what the factors are that need to be considered for assessing the existence of an evocation in such a situation.
