Litigating in a jurisdiction that does not recognize the concept of disclosure—The German Federal Supreme Court clarifies the rules on document production

Abstract: In a recent decision relating to a European patent application (and resulting patent) filed by a non-entitled person, the BGH emphasized that judges shall apply the rules on document production such that the interests of both parties are fairly weighed.
