The Supreme People’s Court of China ruled on the first pharmaceutical patent linkage case after the new Patent Law

Abstract:
In the first case regarding the pharmaceutical patent linkage regime in China, the Supreme People’s Court of China ruled that the validity of a patent did not affect a pharmaceutical patent linkage case. Whether the technical solution of the generic drug falls within the scope of protection of a patent should be judged based on the submitted application for marketing authorization, instead of the actual technical solution implemented.
