Abstract:
In 1999, the Romanian lawmaker replaced the old institution of commercial pledge with a new and more modern one, relevant for the tendency of reforming and adapting our law system, namely with the institution of estate corporal securities. The judicial status of estate corporal securities demonstrates the superiority of the new institution, the simplification of procedures, an efficient and modern publicity, the elimination of exigency concerning the debtor’s dispossession of the goods assigned for guaranty, so on. The institution of estate corporal securities is part of the general system of standing security for commercial obligations.
