Abstract: The author analyses the importance and the observance of the procedural norms concerning the application of the disciplinary punishments. Taking as a starting point a case study, the author makes some critical comments regarding certain interpretations of laws in this field underscoring certain flaws in Romanian labor legislation. This paper could be useful as much for theoreticians as bar, especially, practitioner lawyers
