Abstract: The mediation represents an optional way of solving conflicts amicable, with the help of a third person specialized as a mediator under conditions of neutrality, impartiality and confidentiality. In Romania the mediation is regulated by the Law no. 192/2006 concerning the mediation and the organization of the profession of the mediator .The Law no. 192/2006 contains general dispositions about mediation, dispositions about the profession of the mediator, the organization of the mediator’s activities, procedures and special dispositions about the mediation of certain conflicts. Depending of the time when the court is notified, the mediation can be judicial or extrajudicial. The parts of a dispute can voluntary resort to mediation, even after the beginning of the trial in court. The mediation is viable alternative to the trial in court, which does not involve risks for the disputing parts and keeps the control during the procedure, the parts being able to quit the mediation anytime they want.
