Abstract: Community service is the subject of numerous discussions and controversies in the penal doctrine, especially when it is regarded as an alternative to imprisonment. The article focuses on the evolution in time of this type of punishment, the way of regulation in the national legislation and that of other European states, and it also brings up opposing provisions from several documents adopted by national and international organizations which contain such regulations. There are several advantages grated by this type of punishment for all the participants in the justice process, that is, the criminal, the state, the prejudiced part, the judiciary body and those that supervise the serving of the sentence.
