Abstract: The level of actual delinquency (the total amount of crimes committed in a given period of time), including the black figure of delinquency (the total amount of crimes that are not discovered), is considerably higher compared to the legal delinquency (the crimes that are discovered and judged). This reality is due not only to the skillfulness of the perpetrators, but, mostly, represents a consequence of the victims’ passivity or, to be more precise, of the lack of an apparent victim (both the briber and the person that is bribed have no reasons to inform the judiciary bodies). A series of practical difficulties are approached, come across by the Romanian judges in the process of solving high level corruption cases, the appropriate punishments as well as the preventive role of these and the general impact that corruption has upon the justice system in Romania
