Abstract: The authors begin the present study with a short presentation of the history of the notion and the content of labor conflicts and continue with commentaries on the issue of strike. The paper presents the material and subjective factors necessary for the existence of strike, as well as some of the latest conditions imposed by the last regulation in this domain. The analysis of the main legal acts that regulate labor conflicts and strike in Romania in the last two decades reveals an unjustified legislative policy that restrain the possibilities of exercising this fundamental right.
