Abstract: As a result of the economic and social life development, which triggers an ever larger number of litigations in all the fields, and which have to be solved at an ever faster pace, at the level of the European Union, it is incumbent to find the simplest and quickest judiciary procedures, the European Union member states having to adopt them. The practice showed that the judiciary procedure through which the creditors became to have their rights acknowledged and ask for the pursuance and execution of their debts is, many times, discouraging, it is much more expensive and it takes an extremely long time. The demand for payment is meant, on the one hand, to place the creditor in a much more comfortable position, as compared to his rights, and, on the other hand, to reduce, to a considerable extent, the length of valorization of an uncontested, liquid and enforceable debt, consisting in paying an amount of currency.
