Abstract: [fre] Résumé La question de la transmission des duchés-pairies à l'époque modeme, qui n'a encore fait l'objet d'aucune étude particulière, est plus complexe qu'il peut le sembler à priori. La raison principale de cet état de fait réside dans la nature singulière des trois éléments intimement mêlés qui composaient cette institution : la dignité, l'office et la seigneurie, et, plus particulièrement, des deux derniers d'entre eux. Plus qu'une action préméditée et volontaire de la part de la monarchie, ce sont les cas concrets posés par les successions qui ont fait évoluer la coutume et le droit et qui ont permis à ses règles d'être progressivement précisées. [eng] Abstract The question of transfer of the duchés-pairies at the modern time, which has never been specifically studied, is more complicated than it seems firstly. The main reason of that consists in the peculiar nature of the closely mixed three components which constitute this institution : the dignity, the office and the seigneury (or lordship), and, most particularly, of the last two ones. More than a premeditated and intentional action on behalf of the Monarchy, it is the concrete circumstances generated by the successions that made the custom and the law envolve and which authorized its principles to be progressively explicited.
