La Force du Droit. Contribution à la définition de l'entrepreneur parisien du bâtiment au XVIIIe siècle

Abstract: [eng] Abstract The French historiography does still ignore the concept of the Ancient Regime entrepreneur. In order to contribute to its understanding, this study gets down to analysing the entrepreneur practising in the building field : « the entrepreneur in the building trade » - most of the time a master-mason - term which already in the modern times was a pleonasm. After clarifying the confusion which prevailed over people's minds and which still remains today when we deal with the entrepreneur, the architect or the construction engineer, the experience in law (especially the judicial Archives of the Chamber of the building trade) brings scientifically two necessary and sufficient criteria to a clear and simple definition of the entrepreneur of the building trade : a training and a contract. In future the identification of these different characters should be easier and reliable. [fre] Résumé L'historiographie française méconnaît encore le concept d'entrepreneur de l'Ancien Régime. Afin de contribuer à sa compréhension, la présente étude s'attèle à analyser celui exerçant son métier dans le domaine de la construction : « l'entrepreneur du bâtiment » - le plus souvent maçon - terme qui déjà à l'époque moderne relevait du pléonasme. Après avoir précisé la confusion qui régnait dans les esprits et qui persiste aujourd'hui lorsque l'on traite de l'entrepreneur, de l'architecte ou bien de l'ingénieur, l'expérience du droit (en particulier, les archives judiciaires de la Chambre des Bâtiments à Paris) apporte scientifiquement les deux critères nécessaires et suffisants à une définition claire et simple de l'entrepreneur du bâtiment : une formation et un contrat. Désormais l'identification de ces personnages devrait s'avérer plus aisée et fiable.
