Abstract: [eng] The purpose of this paper is to show that the concept of an "adapted" technology must be completed by the idea of an adapted form of transfer, for a given technology. In many cases, an alternative technology better adapted to the needs of a given developing country does not exist or is available only at a prohibitive price. Then it is the legal system, the type of enforceable contract and clauses which will allow the same technology to be differently transferred, with different risk-sharing and degrees of cooperation, according to the requirements of the development strategy adopted by the recipient country. [fre] L'objet de cet article est de montrer que l'idée d'une technologie adaptée doit être complétée par celle d'une forme adaptée du transfert, pour une technologie donnée. Dans un grand nombre de situations où une technologie alternative n'existe pas ou n'est disponible qu'à un coût prohibitif, ce sera le régime juridique du transfert international, les conditions légales, le type de contrat et de clauses utilisées, qui permettront qu'une même technologie soit transférée à un rythme, avec des répartitions de risque et avec des degrés de coopération qui varient selon les besoins et les stratégies de développement du pays récepteur.
