Abstract: [eng] The article proposes a first general assessment of the changes which affected the American regime of Intellectual Property Rights, in the last 20 years. It shows that in a context marked by the loss of competitiveness of the American firms, this evolution was achieved through legislative as well as through new Courts ruling. Focussing on the case of the living entities and the software packages and business models, it shows that in these two domains of technologies and industries of future, the domain of patentability was considerably widened, creating a new situation. Highlighting the contradictions that this situation has generated, the papers questions the stability and the long term sustainability of such a regime. [fre] L'article propose une première vue d'ensemble des mutations qui ont affecté le régime américain de la PI depuis 20 ans. Il montre que cette évolution s'est effectuée tant par la voie législative que jurisprudentielle dans un contexte marqué par la perte de compétitivité des firmes américaines. En se centrant sur le cas du vivant et des logiciels il montre que dans ces deux domaines de technologies et d'industries du futur, le domaine de la brevetabilité a été considérablement étendu, créant une situation inédite au regard tant de la théorie que des pratiques traditionnelles en ces matières. En pointant les contradictions que cette situation fait surgir, l'article s'interroge sur la stabilité et la soutenabilité d'un tel régime.
