Abstract: [eng] The paper deals with the establishing of a new intellectual property right on living entities in the United States and its economic meaning. Analyzing the origins of this new right and its evolution, the aim of the paper is to exhibit the significant changes of boarders between objects that were traditionally covered by IPR and those that were traditionally excluded from their granting. The article shows that the new right is grounded in radically new orientations of the American public policies and in some specificities of the common law tradition. The key moments which marked the establishing of this new right are then exposed and discussed. Debates, often controversial to which this evolution has given rise, are presented. The article ends by discussing the economic meaning of these changes. [fre] L'article traite des conditions d'installation d'un nouveau droit de propriété intellectuelle sur le vivant aux États-Unis et de sa signification économique. En analysant les origines de ce nouveau droit et son évolution, l'objectif est de montrer qu'il s'agit d'un déplacement significatif de frontière entre objets qui jusque-là relevaient du droit de la propriété intellectuelle et ceux qui en étaient exclus. L'article montre tout d'abord comment ce nouveau droit trouve ses origines dans des orientations radicalement nouvelles des politiques publiques de recherche et dans la spécificité du droit américain de la propriété intellectuelle. Les moments clefs qui ont marqué l'installation de ce nouveau droit sont ensuite exposés et discutés. Les débats, souvent controversés, auxquels cette évolution du droit a donné lieu, sont présentés. L'article conclut en discutant de la signification économique de ces changements.
