Propriété foncière et exploitation agricole: contradictions et conflits

Abstract: [fre] Les institutions gouvernant la propriété foncière, véritable pierre angullaire du système social, se transforment quand elles ne correspondent plus aux nécessités du système économique. Après un rappel de d'émergence et de la codification de da propriété individuelle et absolue, à la période révolutionnaire, l'auteur s'interroge sur la pérennité de cette citadelle, en France, dans la période actuelle. La prolifération de textes réglementant l'usage de la propriété foncière dans les dernières décennies révèle la nature et le dieu des conflits et contradictions entre exploitation agricole et propriété foncière. [eng] Land property institutions which appear to be a cornerstone of the social system are changing with the needs of the economic system. After recalling the birth and codification of the individual and absolute land property rights, during the revolutionnary period, in France, the author questions the perennity of this stronghold in the recent past. The multiplication of new rules concerning the use of rural land, in the last decades, reveals the nature of contradictions and conflicts between farming and land property and their sites.
