Abstract: [eng] Transferring reference quantities between milk producers - The milk quota problem has been dealt with by a great number of jurists. Some of them connect the quota with the land, others think it's a patrimonial right being part of the producer's delivery contract, others, lastly, consider it's an incorporai right or even a simple administrative permission. Professional organizations have adopted opposing stands in favour of the link with the land for some of them with the producer for the others. The French governe- ment adopted provisions to allow direct transfer of the reference quantity to the successor of the disposer providing that he stays on the farm. In some cases, the french autorities provided also for withdrawals of reference quantity to be credited to the national reserve and used later for reallaction. [fre] Le problème des quotas laitiers a été traité par un grand nombre de juristes. Certains rattachent le quota à la terre, d'autres considèrent que c'est un droit patrimonial faisant partie du contrat de livraison du producteur, d'autres enfin estiment que c'est un droit incorporel ou même une simple autorisation administrative. Les organisations professionnelles ont adopté des, positions opposées en faveur du rattachement au sol pour les unes, au producteur pour les autres. Le gouvernement français a adopté certaines dispositions visant à la transmission directe de la quantité de référence au successeur du cédant en place sur l'exploitation. Il a prévu aussi, dans certains cas, des prélèvements de quantités de références au profit de la réserve nationale en vue de leur réattribution.
