La reconnaissance juridique de « l'entrepreneuriat » rural

Abstract: [eng] Rural entrepreneurship: a juridical acknowledgement . A few authors have pointed out the emergence of a new social group belonginig to the rural class -rural entrepreneur- and of new forms of business -rural entreprises. The aim of this article is to know whether a juridical concept could correspond to the sociological and political concept of rural entreprise, in others words if the definition of a juridical status of their own, for entreprises located in the country, could square with the system of classification of the private economic activities. Indeed it must be admitted that the notion of territorial link of an economic unit does not fit in the spirit of private law. [fre] Certains auteurs ont mis en évidence l'émergence d'un nouveau corps social spécifique au milieu rural - les entrepreneurs ruraux - et de nouvelles formes d'entreprise, les entreprises rurales. Cet article a pour objectif de rechercher si au concept sociologique et politique d'entreprise rurale peut correspondre un concept juridique, autrement dit si la consécration d'un statut juridique propre aux entreprises localisées en milieu rural est compatible avec le système de classification juridique des activités économiques privées. Or, force est de constater que l'idée d'appartenance territoriale d'une unité économique est étrangère à la logique du droit privé.
