Contrat agri-environnemental: aide ou rémunération?

Abstract: [eng] AGRI-ENVIRONMENTAL CONTRACTS, SUBSIDIES OR PAYMENTS . Agri-environmental measures, specially agri-environmental contracts, have been analysed as an «alibi», concealing in fact an act of benevolence issue from the Administration and therefore as subsidies without any counterpart. This survey tries hard to refute such an analysis from the legal notion of the sufficient and valuable consideration ant to demonstrate that agri- environmental «subsidies» constitute the price for services promised by the farmers. So they cannot be considered as technical trade barriers condemned by the wro rules. [fre] Les mesures agri-environnementales, les contrats agri-environnementaux notamment, ont été analysés comme un «alibi», dissimulant au fond un acte unilatéral émanant de l'administration et donc finalement comme des aides publiques sans contrepartie. Cette étude s'attache, à partir des notions juridiques d'objet et de cause du contrat, à réfuter une telle analyse et à démontrer que les aides agri-environnementales sont de véritables rémunérations pour services rendus par les agriculteurs. Elles ne peuvent de ce fait être considérées comme des barrières non tarifaires contraires aux engagements internationaux dans le cadre de l'OMC.
