Abstract: [fre] Cet article propose d'analyser la mesure d'interdiction de la revente à perte établie pour la première fois en 1 963 et dont la dernière formulation date de la loi Galland en 1996. La théorie de l'organisation industrielle offre différentes explications aux pratiques de revente à perte, et leur examen permet de discuter de la pertinence de cette règle. [eng] This paper aims at capturing the ambiguous impact of the ban on loss leading that prevails in France since 1 963. We use the theory of indu strial organisation to understand the logic of loss leading practices. We then discuss loss leader banning, pointing out its impact on the competition between retailers, on the relationships between producers and retailers and on the consumers' surplus.
