Abstract: The present paper is meant to analyze and speak about article 3 of the European Convention on Human Rights that states that “Nobody can be submitted to torture, punishments or inhuman or humiliating treatments”, irrespective of their theoretical or practical aspects. The paper is also meant to observe the way this article is applied by the European Court on the Human Rights in various situations that appear as a consequence of the traffic and illicit consumption of narcotics. The solutions offered by the Court - perfectly well sustained and rooted into the everyday reality - are, according to my opinion, a model to be taken into account and a source of inspiration for the Romanian Courts of Appeal.
