Abstract: Since the inception of the World Trade Organization (WTO) in 1995, one of the most important questions that is constantly being raised and debated over is whether the new dispute settlement protocols covered by the Dispute Settlement Understanding (DSU) are sufficient to provide effective remedies against unfair trade practices. Critical questions such as what determines whether a country will involve into trade disputes or not, or if a country involves into trade disputes then what factors determine its chance of winning or losing the disputes- have always remained in focus.
