Marco jurídico y principales instrumentos de la cooperación transfronteriza institucional en Europa

Abstract: En este artículo realizamos un recorrido desde los orígenes de la «cooperación transfronteriza institucional» en Europa hasta la actual «cooperación territorial». Definimos y comparamos los conceptos de «cooperación institucional» y «cooperación tradicional” y auguramos un acercamiento entre ambas. Describimos el principal marco legal de la «cooperación transfronteriza institucional» y analizamos sus principales instrumentos, prestando una atención especial a la Eurorregión, a la Agrupación Europea de Interés Económico (AEIE) y a la más reciente figura de la Agrupación Europea de Cooperación Territorial (AECT), referentes todos importantes de la cooperación territorial. Finalizamos con algunas breves referencias a las dificultades de llevar a cabo la cooperación transfronteriza y al proyecto de integración europea, en el que la gestión de las fronteras interiores se ha convertido en un elemento esencial para consolidar el actual proceso de construcción de Europa. In this article, we start with the origins of «institutional cross-border cooperation» in Europe, covering up to today’s «territorial cooperation». We define and compare the concepts of «institutional cooperation» and «traditional cooperation», focusing on analyzing the former and predicting an approximation between the two types of cooperation. We describe the main legal framework for «institutional cross-border cooperation» and analyse its main instruments, placing special attention on the Euroregion, the European Economic Interest Grouping (EEIG) and the more recent figure of the European Grouping of Territorial Cooperation (EGTC), all of which are important references for territorial cooperation in Europe. We finish with some brief references to the current European integration project, in which border management has become an exceptional test Bedfor deciphering certain keys in this construction process.
