Abstract:
The article proposes an institutional approach to the phenomenon of the polyjuridicism, ie the coexistence of different legal systems (or elements thereof) in a single society. It is shown that modern institutional theory may be an adequate tool for describing poliyuridizma and to explain the existence of this phenomenon, including in the sphere of economic relations. Features institutional approach to poliyuridizmu demonstrated on concrete examples poliyuridizma in today's North Caucasus. Based on the author's field data show that the effect of the legal system, the alternative to Russian law (Islamic and traditional law), in the economic sphere of the North Caucasus is very limited. At the same time the preservation of specific rules belonging to these systems can be explained by the existence of the beneficiaries and ensure the effectiveness of the mechanisms of these standards. This conclusion is illustrated by the detailed analysis of the solutions of the land question in one of the rural settlements of mountain Dagestan.
