Abstract:
The article is devoted to the issues of public relations regulation in the field of observance by local governments of the human rights and freedoms in the municipal territory. The focus is on the problem of interaction between state authorities and local government in terms of observance and protection of human and civil rights and freedoms. The authors consider this aspect using the municipal entity of “the city of Ekaterinburg” as an example. The article analyzes amendments to the Constitution of the Russian Federation of January – March 2020, which imply the renunciation of powers of municipal authorities in the field of public order protection, which is, at least, surprising. Currently, local governments must assist citizens and their associations, involved in the public order protection, in creating conditions for the popular squads’ activity, carrying out measures for territorial and civil defense and extremism and terrorism prevention. In this context the authors consider the elimination of the function of protecting public order from their jurisdiction to be the utter nonsense. In this respect, a conclusion is made that such a limitation of the scope of local government activity leads to their dependence on public authorities in the field of legal relations, creates the prerequisites for the violation of human and civil rights and freedoms in the territory of municipalities. Moreover, these changes completely cross out the prospect of creating a municipal militia, which will lead to a new wave of legislative innovations aimed at bringing the existing regulations to the requirements of the updated Constitution of the Russian Federation. The article analyzes the federal legislation on local government, police, municipal legal acts adopted by local authorities of the city of Ekaterinburg. General and specific scientific research methods are used: forecasting, statistical, formal-legal and technical-legal.
