Abstract: In recent years European institutions have recommended governments to adopt demand-led innovation policies. A specific administrative instrument has been designed – the so called Pre-Commercial Public procurement (PCP) – allowing public administrations to purchase R&D services targeted to future public demand of good and services, while being compliant with the general legislation on State Aid and public procurement. This scheme, however, is not largely adopted due to a number of subtle legal and administrative issues. The paper discusses the economic and legal foundations for demand-led innovation policies, examines the new scheme and advances some proposals on how to improve upon it.
