Abstract: The purchase of goods meant to assure the functioning of lower education establishments in the best conditions, of the educational process in accordance with the legal requirements of our country are followed conforming to the law , respectively to the Emergency Ordinance no. 34/2006, with the later modifications and completions. According to the Emergency Ordinance no 34/2006, some of the lower education establishments meet the legal conditions of being contracting authorities, having competences regarding the assignment of public procurement contracts. Due to the difficulties met by lower education establishments in exercising the role itself of contracting authorities and also by the necessity of efficient use of public funds for the procurement process, the purchase of some of the goods which are necessary to entities from schools is utterly imposed in a centralized system.
