Abstract:
It requires greater attention in the foreshadowing framework prefiguring the materialization of the association agreements to constitute legal companies, whatever their form, both in the contractual phase and then in the deliberative process of general meetings, legislative limits being possible to be mitigated through a forward-looking attitude. Thus, in the exercise of freedom of contracting, protecting special provisions may be agreed by the associates in the partnership agreements, in order to counter the current legal vacuum, as the legal regime of corporate pacts are not expresis verbis regulated
