Abstract: Delay in the courts, although not a new com plaint, has been the subject of much current discussion. De lay, as used in the present article, is the time interval between the point when a case is "at issue" and the trial. In the fed eral courts this period varies from 4.1 months to 39.1 months. In the state courts it varies from 1.0 month to 52.9 months. During the last seven years delay in the federal courts has in creased, whereas delay in the state courts has decreased.
