Abstract: The EU principle of an open market economy with free competition are having a significant effect on Italian contract law. Private autonomy is being affected by the requirement to lower the number of market failures. Information, transparency, contractual equilibrium, proportionality and fairness have become extremely important. The field of application of the ban on abusing legislation that protects the weaker party is being widened. New contractual remedies are being created. A modern competitive model of contracts, which brings higher levels of economic efficiency and more incisive ethical control of the market through protection of the individual, is thus gaining ground.
