In various branches of the Russian law the category «residence» is treated differently. It results in the legal conflicts in the lawenforcement activity that in its turn leads to the violation of the citizens’ rights, freedoms and their legal interests. The problem iscomplicated by the facts that the rules of resolving legal conflicts of equal validity law norms offered by the researchers can’t be appliedas the public relations connected with the creation of necessary conditions for guarantees of the citizens’ rights, freedoms and executionof their duties are of interdisciplinary nature. The ways of resolving the mentioned above conflicts are offered in the article.
