Abstract: The article is devoted to the problem of freedom of the will in civil law, that is insufficiently explored in civil law science. Historical and legal approach to the analysis of formation and development of the concept of freedom of the will in subjective civil law, stated in the article, let us create the definite methodology of research of this legal phenomenon in contemporary Russia.
