Abstract: The summary. In this paper, we consider the negative consequences of unjust enrichment and the types of damages. Analyzed jurisprudence and touches on some aspects of law Art. 1105, 1107 Civil Code. Revealed contradictions in matters of liability for unjust enrichment theory and in practice. Conclusion: The urgent need to form a unified approach and refining the rules of the Civil Code.
