Abstract:

The article addresses the amendment of the Russian legislation with the introduction on October 1, 2015 of the mechanism of recognition of citizen-debtor as bankrupt. The restructuring can be regarded as an effective tool of the state social and economic policy; however, it does not eliminate problems associated with its practical application. Debating approaches to the institution of citizen’s bankruptcy are complicating the legislative process. Striving for the optimal decision on jurisdiction of bankruptcy cases makes it necessary to introduce amendments to the law which has not entered into force yet. The article reviews the issues of adequate legal pressure in the case of misconduct of a citizen-debtor. Also, the effectiveness and consequences of recognition as a bankrupt appear to remain rather unclear.

В статье рассматриваются вопросы модификации российского законодательства в связи с введением с 1 октября 2015 г. механизма признания гражданина-должника банкротом, который может рассматриваться как действенный инструмент реализации социально-экономической политики государства, что, однако, не снимает совокупности проблем, сопровождающих его применение на практике. Сложный законотворческий процесс был обусловлен дискуссионностью подходов к вводимому институту банкротства граждан. Стремлению к выработке наиболее оптимального решение по подведомственности дел о банкротстве граждан заставляет вносить изменения в еще не вступивший в силу закон. В статье рассмотрены современные проблемы адекватности правового воздействия при возможном недобросовестном поведении гражданина-должника. Кроме того, вызывают вопросы и эффективность установленных правовых последствий признания гражданина банкротом.
