Abstract:

The article studies government regulation of intellectual property. The subject of this study is the role and importance of state influence in such areas as copyright, industrial property, means of individualization. The purpose of work is to identify problems linked to state regulation of intellectual property relations in the above-mentioned areas. The paper shows a significant role of the state in the field of developments, inventions, know-how, and other kinds of intellectual property. Also, the author considers the state influence on parallel imports, customs movement of goods and the customs register in the context of intellectual property. It is concluded that Russia should allow parallel imports, protect all objects of intellectual work and carefully study these issues at the state level.

Статья посвящена государственному регулированию интеллектуальной собственности. Предметом данного исследования являются роль и значение государственного влияния на такие области, как авторское право, право промышленной собственности, средства индивидуализации. Цель работы - выявить проблемы государственного регулирования отношений в этих сферах интеллектуальной собственности. В работе показана роль государства и сделан вывод о широком влиянии на развитие не только изобретений, ноу-хау, но и других объектов интеллектуальной собственности. Рассмотрена проблема государственного влияния на параллельный импорт, таможенное перемещение товаров и таможенный реестр, имеющих отношение к объектам интеллектуальной собственности. Сделан вывод о необходимости введения в России параллельного импорта, защиты всех объектов интеллектуального труда и тщательной проработки этого вопроса на государственном уровне.
