Abstract:

The paper analyzes the Russian legislation regarding the contract procurement system. The provisions of Federal Law No. 44-FZ “On the Contract System of the Federal and Municipal Procurement of Goods, Works and Services” of May 4, 2013, are examined in terms of their correspondence to the statutes of the Civil Code of the Russian Federation. Based on the application of the civil law rules and the effectiveness of the law enforcement practices, proposals for improving Federal Law No. 44-FZ of May 4, 2013, are made. The author’s opinion on the prospects of further development of federal procurements is expressed. It is proved that in order to ensure the trouble-free functioning of organizations acting as contractors to public contracts, the contract system legislation should be amended appropriately.

Статья посвящена анализу законодательства Российской Федерации о контрактной системе в сфере закупок. Рассмотрены положения Федерального закона от 05.04.2013 № 44-ФЗ «О контрактной системе в сфере закупок товаров, работ, услуг для обеспечения государственных и муниципальных нужд» на предмет их корреляция с нормами Гражданского кодекса Российской Федерации. На основе анализа применения норм гражданского законодательства, результативности его практической деятельности вносятся предложения по совершенствованию Федерального закона от 05.04.2013 № 44-ФЗ. Представлено мнение автора о перспективах развития осуществления закупок федеральными органами исполнительной власти. Обосновывается, что в целях обеспечения стабильного функционирования деятельности организаций, выступающих в качестве исполнителей по государственным контрактам, должно быть внесено соответствующее изменение в законодательство о контрактной системе.
