Abstract:

The paper deals with legal regulation of managing the owner’s property in the field of education. The subject of the study is laws and regulations that establish the legal framework for managing the property of the owner in the education sphere. The purpose of the study was to determine the specifics of the legal regulation of relationships arising in the management of the owner’s property in the sphere of education taking into account the latest amendments to law. The paper analyzes federal laws and subordinate statutory documents that characterize legal relations concerning the property management in the sphere of education where the state, the budget, autonomous and private institutions are the related parties. The research work reveals the specifics of enjoyment of the right to operational management in respect of the powers of the property owner and the legal entity. The advantages and disadvantages of the current legislation on management of the owner’s property in the sphere of education are identified. It is concluded that the relations arising in the management of the owner’s property are of a complex nature; amendments to the legal standards in the part of control over the proper use of the owner’s property have a positive orientation but the laws and regulations in this field lack consistency.

Статья посвящена правовому регулированию управления имуществом собственника в системе образования. Предмет исследования - нормативно-правовые акты, устанавливающие правовую основу деятельности по управлению имуществом собственника в сфере образования. Цель исследования - определение специфики правового регулирования отношений, возникающих при управлении имуществом собственника в сфере образования, с учетом последних изменений законодательства. В работе проведен анализ федеральных законов и подзаконных нормативно-правовых актов, на основе которого дана общая характеристика правоотношениям, связанным с управлением имуществом в сфере образования, участниками которых являются казенные, бюджетные, автономные и частные учреждения; выявлены особенности осуществления права оперативного управления в части правомочий собственника имущества и самого юридического лица; определены достоинства и недостатки действующего законодательства об управлении имуществом собственника в сфере образования. Сделан вывод о специфике и сложном характере отношений, связанных с управлением имуществом собственника, положительной направленности изменений правовых норм в части контроля за надлежащим использованием имущества собственника и об отсутствии системности нормативно-правовых актов.
