Abstract:

This article reviews the problem of choosing an optimal strategy of behavior in the system of WTO trade dispute for Russia. The analysis is based on evaluating prospects of new WTO members. To conduct this analysis we examined the Chinese experience that has demonstrated that they prefer to use the system of «changeable measures» and an alternative tool - the prolongation of the trade dispute. Furthermore, it can be said that China preferred to accumulate experience on the first stage of membership. The analysis using game theory has demonstrated that Russia should actively participate in the WTO, not to disturb the WTO rules. This policy leads to the healthy competition and effective development in long-term. The econometric model has demonstrated that language and trade experience affect on the result of a trade dispute. Mainly the increase of the third parties leads to a Respondent losing the trade dispute.

В статье рассматривается проблема выбора оптимальной стратегии России при решении торговых споров в рамках ВТО. Анализ базируется на оценке перспектив использования различных методик, которые позволяют определить необходимые действия для победы в торговом споре. Для проведения реального анализа были изучены механизмы участия Китайской Народной Республики (КНР) в торговых спорах, которые продемонстрировали, что Китай предпочитает использовать систему «кочующих мер», а также сознательно удлиняет определенные торговые споры. Необходимо добавить, что на первой стадии членства в ВТО Китай предпочитал накапливать опыт путем участия в торговых спорах в качестве третьей стороны. Использование моделей теории игр продемонстрировало, что России необходимо активно участвовать в различных механизмах ВТО, при этом не нарушая правила. В долгосрочном периоде такая стратегия приведет к существенной выгоде. Построенная эконометрическая модель показала, что такие факторы, как знание языка, торговый опыт, влияют на результат в торговом споре. Большое количество третьих сторон также приводит к тому, что ответчик проигрывает торговый спор. Развитие идей, заложенных при построении данной модели, может значительно усилить потенциал России при участии в торговом споре.
