Abstract:

Article Retracted.The rationality is important category in system of private-law regulation and represents the branch principle of civil law (characterizes the most essential lines of civil law). Despite all importance of this category of its legal definition in the civil legislation still isn’t present. In a sense between reason and the right it is possible to put an equal-sign. The right represents the reason phenomenon expressing objective values and requirements of human life and being an unconditional source and absolute criterion of all human establishments including the positive (hand-written) law.

Статья отозвана.Разумность является важной категорией в системе частноправового регулирования и представляет собой отраслевой принцип гражданского права (характеризует наиболее существенные черты гражданского права). Несмотря на всю важность этой категории, ее легального определения в гражданском законодательстве до сих пор нет. В определенном смысле между разумом и правом можно поставить знак равенства. Право пред- ставляет собой феномен разума, выражающий объективные ценности и требования человеческого бытия и являющийся безусловным источником и абсолютным критерием всех человеческих установлений, включая позитивное (писаное) право.
