Abstract:
This paper analyses the political and social aspects of a deeply-rooted phenomenon in the Concejil (Council charter land system) and rural setting of the Late Middle Ages: the illegal misappropriation of common land and goods. The sphere studied is that of Avila and its Region, The misappropriations brought two antagonistic social groups into conflict: the urban lesser nobility, owners of important areas of land and livestock, and the modest peasants of the villages, The settlement of the conflict, which was genuinely judicial, involved other authorities, including the king. The legal dispute clearly reveals the autonomy of those in power as opposed to specific interest groups. Furthermore, the specific nature of the political culture of the common people, the most active defenders of communalism, is likewise brought to light.
