Abstract: The aim of the article is to present chosen legal issues concerning the requirements to be fulfilled by the entities which apply for a permit to run business as national payment institutions. The article raises i.a. the controversial topic of the required financial resources to cover own funds. The above question may also be connected to the entitlement given to KNF to demand that a national payment institution’s own funds be risen or to allow it to have own funds in the amount below the limit required 16k on bbby the law. The article also describes the issue of legal succession of several entities during proceedings that are already pending. Finally, practical doubts also arise with respect to the NBP President’s opinion issued in connection with every permit for rendering payment services described in article 3 paragraph 1 point 5 of the Payment Services Act (acquiring), partial appeal against the opinion and the results that such an appeal may cause in further proceedings.
