Abstract:
The purpose of this paper is to present my theory of remuneration rules seen from the perspective of labor law and compare such an approach with the theory of management, and then verify these views against the practice of companies. In my research, which was performed in the years 2009–2017, I?? focused on enterprises that are directly affected by the global labor market and must cope with its challenges through the optimalization, on the one hand, and by incentivizing rewards for employees, on the other hand. When it comes to the examined group, I chose 450 autonomous sources of labor law in force – on the establishments operating in different sectors. The concept of the remuneration rules to be applied to employees is not intended to be purely dogmatic but rather to be useful both for social partners that make up autonomous sources of law and for the parties to the employment contract. My considerations are based not only on reading literature on actual regulations applicable in companies that sometimes are not congruent with practice. It seems to me that it is already time for representatives of both sciences to sit at a common table to consider and identify, where possible, of course, the mutualization of presented content that could be used both during the preparation of labor law and the interpretation of the provisions by lawyers, as well as in the creation of the theory of remuneration of the management that corresponds to legal requirements.
