Abstract: If the tutor is the central figure of the tutelage, in order to control and supervise the tutelage function, there is an another mechanism intervenes - the Family Council. The Family Council was governed by the 1864 Romanian Civil Code under the influence of the Napoleon Code and was the supreme body of tutelage. Currently, this legal institution is reintroduced into the New Civil Code and regains its regulation in Article 124-132.
