Abstract: The most important advantages and disadvantages of the collective claims from point of view of both the victims and society have been identified in the article. The strong and the week points of the procedure have been brought out mostly on the basis of a comparative analysis with individual actions. The collective claim has considerable advantages mainly regarding injuries that have affected many victims whose damages have been low. Some of the disadvantages which are typical for the American procedure (class action) exist and others can possibly appear in countries in the European Union too. For its part this determines the need to envisage appropriate safety mechanisms.
