Trends in the Development of the Legal Framework of the Stabilization Proceedings According to the Proposed Changes in the Commercial Law

Abstract: In the month of May 2022, a Draft Law on Amendments and Supplements to the Trade Law was proposed for public discussion, which envisages serious changes in the matter of merchant stabilization. The present study aims to examine some of the proposed changes in the matter of stabilization proceedings, in comparison with the current legal framework and with the provisions of Directive (EU) 2019/1023. The topicality of the topic is determined by the need to achieve harmonization in the legal framework of individual member states, which is synchronized with European standards and creates effective mechanisms for the preventive restructuring of viable enterprises with financial difficulties.
