Abstract: The article presents the main aspects of the concept of the labour contract regulated in Art. 230, para. 1 of the Labour Code, as the legal nature of this contract is analysed. In this regard, the legal character of the learning during the process of work clause is clarified. The thesis has been substantiated that this clause is not a modality of the contract, but only an element of its minimal necessary contractual content.
