Abstract: The present scientific research is dedicated to the analysis of the legal regulations of a relatively new legal institute in Bulgarian legislation - the preventive restructuring proceeding of a merchant, introduced with the amendments to the Commercial act, in force since 01.07.2017. The aim is to emphasize the role of this new framework as a procedure that could potentially limit the negative trends of an increasing number of insolvent merchants and as a legal institute that is accessible and in view of the achieved results is preferred by viable enterprises facing temporary financial difficulties, providing a possibility of a second chance for honest entrepreneurs.
