Abstract:
In the paper here presented the good faith in the contract’s formation has been analyzed and namely, some problems dealing with the good faith in the contract law, but also in the contracts with international element regulated by international private law norms, in particular. A special attention has been paid on different conceptions about the legal nature of good faith as a legal principle and as a positive obligation. A brief comparative analyze of the legal regulation of good faith in the contract law in some countries has been as well made. Some international sources also have been mentioned, establishing obligations for contract’s parties to respect good faith in the process of contract’s formation. Finally, some general conclusions have been made.
