Abstract: In the public sector, the occurrence of labor-legal disputes between an employer and workers/employees is a common problem. The presented report will consider a part of the problems that exist regarding the resolution of labor disputes between the parties with the help of mediation. According to the general legal provision, employers have much more powers and should exercise their control function over the performance of duties and responsibilities of workers/employees. This rule applies and applies to the public sector as well. The problem is how to carry out this function in the most correct and correct way, without violating the basic principles of labor law and without infringing the labor rights of workers. In most cases, incorrect actions are observed on the part of employers when violations are established, on the other hand, incorrect action is also observed on the part of workers/employees when specific situations arise, which is a prerequisite for the emergence of labor-legal disputes, which transform into legal proceedings.
